PREVIEW; Bullock v. Fox: The Meaning of the Term “Land Acquisition” in Mont. Code Ann. § 87–1–209(1)
Abstract
This case presents the Court with two issues. The first is whether Petitioners (collectively “Gov. Bullock”), Governor Bullock, in his official capacity, and Martha Williams, in her official capacity as Director of the Fish, Wildlife, and Parks Department (“FWP”), have standing to bring suit against Respondent (“AG Fox”), Attorney General Fox, in his official capacity. The second issue before the Court is whether the term “land acquisition” in Mont. Code Ann. § 87–1–209(1) applies to non-possessory property interests.
