Local Government Participation in NEPA - Can it Comply with Montana's Right of Participation and Right to Know?

Abstract

This paper considers public access to information when Montana local governments become involved with federal NEPA planning efforts. Montana's Constitution contains unique right of participation and right to know provisions that provide broad public access to information, but some federal plannign processes allow only limited public disclosure. This paper considers how best to reconcile the two levels of public access while allowing local governments to fully participate in federal planning, specifically NEPA.
